1. INTRODUCTION

These Terms of Service and Subscription Agreement ("Terms") govern your access to and use of the FPRO website, mobile applications, digital services, content, products, and subscriptions (collectively, the "Services").

The Services are operated by FPRO ("FPRO", "we", "us", or "our").

By accessing our website, creating an account, purchasing products, subscribing to services, or using any part of the Services, you agree to be legally bound by these Terms.

If you do not agree to these Terms, do not use the Services.

2. ELIGIBILITY

You must be at least 18 years old to make purchases through the Services.

If you purchase products or subscriptions on behalf of a child, you represent that you are the child's parent or legal guardian and have authority to accept these Terms on their behalf.

3. PRODUCTS

FPRO offers physical products including, but not limited to:

  • FPRO Essential Kit
  • FPRO Complete Kit
  • Ball Mastery Training Mat
  • Footballs
  • Grip Socks
  • Other training accessories

Product descriptions, images, colors, packaging, and specifications are for illustrative purposes only and may vary.

We reserve the right to modify, discontinue, limit, or refuse sales of any product at any time.

4. APP ACCESS INCLUDED WITH PRODUCT PURCHASES

Purchase of the FPRO Essential Kit or FPRO Complete Kit includes access only to the basic functionality of the FPRO application, specifically the standard training video content made available by FPRO.

Certain premium features, tools, content, competitions, challenges, rankings, rewards, coach feedback, community features, analytics, future updates, and other enhanced functionality may require an active FPRO Premium subscription.

FPRO reserves the right to determine which features are included in Basic Access and which features require Premium Access.

5. FPRO PREMIUM SUBSCRIPTION

5.1 Automatic Enrollment

When purchasing eligible products through the FPRO website, FPRO Premium may be automatically added to your order and checkout process.

By completing checkout, you expressly request and consent to enrollment in the FPRO Premium subscription program under the terms described herein.

5.2 Free Trial

Your subscription includes a fourteen (14) day free trial period beginning on the date of purchase.

No subscription fee will be charged during the free trial period.

5.3 Payment Authorization

By completing your purchase, you authorize FPRO and its payment processors to securely store and use the payment method used during checkout for future subscription charges.

You further authorize recurring charges in accordance with these Terms.

5.4 Subscription Fee

Unless canceled before the expiration of the free trial, FPRO will automatically charge USD $29.99 per month to your selected payment method.

Charges will recur automatically every month until canceled.

5.5 Automatic Renewal

Your subscription automatically renews at the end of each billing period unless canceled.

You authorize recurring monthly billing until you terminate the subscription.

5.6 Cancellation

You may cancel your subscription at any time through your account settings or by contacting hello@fpro.com.

Cancellation prevents future billing only.

Cancellation does not retroactively refund charges already processed.

If cancellation occurs during the free trial period, no subscription fee will be charged.

5.7 Failed Payments

If a payment fails, FPRO may:

  • Retry the transaction;
  • Suspend access to Premium features;
  • Terminate the subscription;
  • Use lawful collection procedures to recover unpaid amounts.

6. NO GUARANTEED RESULTS

FPRO provides educational and training content only.

We do not guarantee:

  • Football performance improvements;
  • Selection by clubs, academies, or teams;
  • Scholarships;
  • Professional contracts;
  • Athletic achievements;
  • Specific training outcomes.

Results vary based on numerous factors outside our control.

7. HEALTH AND SAFETY DISCLAIMER

Participation in physical activity carries inherent risks.

You acknowledge and agree that:

  • Use of FPRO products and training content is at your own risk;
  • Users should train in a safe environment;
  • Users should consult a physician before beginning any exercise program where appropriate;
  • Parents and guardians remain solely responsible for supervising children.

To the fullest extent permitted by law, FPRO shall not be liable for injuries, accidents, property damage, or losses arising from participation in training activities.

8. INTELLECTUAL PROPERTY

All content provided through the Services, including:

  • Videos
  • Graphics
  • Software
  • Training programs
  • Designs
  • Trademarks
  • Logos
  • Text
  • Audio

is owned by FPRO or its licensors and is protected by intellectual property laws.

You may not:

  • Copy;
  • Reproduce;
  • Distribute;
  • Modify;
  • Sell;
  • Reverse engineer;
  • Create derivative works;

without prior written permission.

9. USER ACCOUNTS

You are responsible for:

  • Maintaining account security;
  • Protecting login credentials;
  • All activity occurring under your account.

FPRO may suspend or terminate accounts at its sole discretion.

10. USER CONTENT

If you upload videos, comments, feedback, images, or other content, you grant FPRO a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, distribute, display, and create derivative works from such content for business, marketing, operational, and product improvement purposes.

You warrant that you have all rights necessary to grant such license.

11. REFUNDS AND RETURNS

Physical Products

Unless otherwise required by law, physical products may be returned within thirty (30) days of delivery.

Returned products must be:

  • In reasonable condition;
  • Not intentionally damaged;
  • Returned according to instructions provided by FPRO.

Customers are responsible for return shipping costs unless otherwise required by law.

Subscription Fees

Except where required by applicable law, subscription fees already billed are non-refundable.

Canceling a subscription prevents future charges only.

Digital Services

Digital products, digital content, and activated subscriptions may be non-refundable to the maximum extent permitted by applicable law.

12. THIRD-PARTY SERVICES

The Services may integrate with third-party providers including payment processors, analytics services, cloud providers, and app marketplaces.

FPRO is not responsible for third-party services or their actions.

13. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES, PRODUCTS, SOFTWARE, CONTENT, AND SUBSCRIPTIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE."

FPRO DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED AVAILABILITY.

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

FPRO SHALL NOT BE LIABLE FOR:

  • INDIRECT DAMAGES;
  • INCIDENTAL DAMAGES;
  • SPECIAL DAMAGES;
  • CONSEQUENTIAL DAMAGES;
  • LOSS OF PROFITS;
  • LOSS OF DATA;
  • LOSS OF BUSINESS;
  • LOSS OF OPPORTUNITY.

FPRO'S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT PAID BY YOU TO FPRO DURING THE PRECEDING TWELVE (12) MONTHS; OR

(B) USD $100.

NOTHING IN THESE TERMS LIMITS LIABILITY WHERE SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAW.

15. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless FPRO and its officers, directors, employees, affiliates, contractors, licensors, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from:

  • Your breach of these Terms;
  • Your misuse of the Services;
  • Your violation of law;
  • Your violation of third-party rights.

16. FORCE MAJEURE

FPRO shall not be liable for delays or failures caused by events beyond its reasonable control, including:

  • Natural disasters;
  • War;
  • Terrorism;
  • Government actions;
  • Internet outages;
  • Power failures;
  • Labor disputes;
  • Cyberattacks.

17. PRIVACY

Your use of the Services is also governed by our Privacy Policy.

18. CHANGES TO THESE TERMS

We may update these Terms at any time.

Updated versions become effective upon posting to the website.

Continued use of the Services constitutes acceptance of the revised Terms.

19. GOVERNING LAW

These Terms shall be governed exclusively by the laws of the Republic of Lithuania.

20. JURISDICTION

To the maximum extent permitted by applicable law, all disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Lithuania.

If mandatory consumer protection laws provide additional rights or forums that cannot legally be excluded, those rights remain unaffected.
